1. Scope
Our General Terms and Conditions in the version applicable at the time of your order apply exclusively to all business relationships between FÜRSTENBERG and the purchaser. FÜRSTENBERG must confirm any deviation to this expressly in writing. We will not recognize conflicting terms and conditions.
2. Conclusion of the agreement
The General Terms and Conditions Porzellanmanufaktur FÜRSTENBERG GmbH shall be recognized at the conclusion of the agreement.
The agreement is formed by our acceptance of your offer of an agreement, which is made by your order, through our order confirmation
3. Right of exchange and return privilege free of charge
The purchased FÜRSTENBERG articles can be returned without any statement of reasons within a period of two weeks after receipt (with the exception of personalized articles). The sending of the goods or a written cancellation suffices for the observance of this deadline. Goods may be returned at our cost and risk. The goods should be sent back in their original packaging or in packaging that provides comparable protection. The goods should be returned through our free-of-charge pick-up service. FÜRSTENBERG will commission the forwarder to pick up the goods from the customer.

In the case of deterioration, breakage or loss (exception: presence of the safe custody receipt for the return), we reserve the right to demand compensation. Generally, this could justify your obligation to pay the entire purchase price.
In the case of return, the agreement will be cancelled and a refund credit will be made for already made payments upon return of the delivered goods.
4. Packaging and shipping
The flat charge for shipping costs (up to a maximum of 30 kg) amounts to € 6.50 within Germany and € 20.00 within the rest of Europe, other countries on inquiry.
5. Delivery
Delivery is made free house duty unpaid and untaxed and only within the countries selectable in the Online Shop (Germany, Switzerland, Norway, EU countries). Statements about the delivery deadline are not binding. We are entitled to partial deliveries. No shipping costs will be charged for subsequent deliveries.
6. Due date and payment
FÜRSTENBERG will charge the customer the purchase price once the order confirmation has been sent; with that, prepayment is agreed. Payment is considered delayed if not made within 30 days of receipt of the invoice. The customer can pay the purchase price by direct debit (applies only within Germany) or by credit card.
The listed prices are in EURO and contain the statutory VAT.
7. Guarantee and liability
Should delivered articles have material or manufacturing defects, please make complaints about visible defects - particularly transport damage - immediately to FÜRSTENBERG or the person who has delivered the article. During the legal period for the guarantee of 2 years after receipt of the goods, according to your choice, FÜRSTENBERG will either repair or replace the article. If the remedy of the defect or the replacement delivery is ineffective or if the replacement delivery is not possible or would only be possible at unjustifiably high cost, according to your choice, you are entitled to back out of the purchase through a rescission of the agreement or to a reduction of the purchase price.
More far-reaching claims of the customer - based on whatever legal grounds - are precluded. Therefore, FÜRSTENBERG is not liable for damages which do not occur directly to the delivered object. In particular, FÜRSTENBERG is not liable for lost profit or other damage to assets of the customer. If FÜRSTENBERG's liability is precluded or limited, this applies as well to FÜRSTENBERG's employees, representatives or vicarious agents.
The above-mentioned disclaimer does not apply if the cause of damage is based on intent and gross negligence or injury to a person’s life, limb or health. Furthermore, it does not apply if the customer asserts claims based on §§ 1,4 of the Product Liability Act (Produkthaftungsgesetz) or claims from a composition or durability guarantee § 443 of the German Civil Code (Bürgerliches Gesetzbuch, BGB).
In the case of negligent violation by FÜRSTENBERG of an obligation important to the agreement, the liability to compensate for property damage or personal injury is limited to the damage or injury arising typically.
The guarantee of 2 years applies as well to claims replacement due to secondary damage if no claims are asserted for unlawful action.
8. Reservation of ownership
The delivered goods remain in the ownership of FÜRSTENBERG until paid in full.
9. Other
The laws of the Federal Republic of Germany apply to the exclusion of the UN Sales Convention.
The invalidity of individual provisions does not affect the validity of the rest of the agreement or the General Terms and Conditions.
